Welcome to Chukka Clothing LLC ("Trader," "we," "us," or "our"), a Delaware limited liability company specializing in bespoke, handmade suits and clothing. These Terms and Conditions ("Terms") govern your access to and use of our website (the "Site") and your purchase of products from our Shopify store. By accessing the Site or placing an order, you agree to be bound by these Terms. If you do not agree, please do not use the Site or make any purchases.

We reserve the right to update or modify these Terms at any time. Changes will be effective upon posting to the Site, and your continued use constitutes acceptance of the revised Terms. It is your responsibility to review these Terms periodically.

Definitions

In these Terms:

  • "Consumer" or "You": A natural person purchasing for personal use, not business purposes.
  • "Day": Calendar day.

  • "Distance Contract": Any contract concluded remotely via our Site without physical presence.

Applicability

  1. These Terms apply to every offer made by us and to every Distance Contract realized between us and you.
  2. We currently ship to the United States [and specify other countries if applicable, e.g., Canada]. Orders to other locations may be refused or subject to additional terms. If shipping to the EU or other regions with mandatory consumer protections, additional laws may apply.
  3. Prior to concluding a Distance Contract, these Terms will be made available to you. If not reasonably possible, we will indicate how to access them.
  4. If the Distance Contract is concluded electronically, these Terms will be provided electronically for easy storage on a Durable Medium.
  5. In cases where specific product-related terms apply in addition to these Terms, you may invoke the most favorable provision in the event of conflicts.

The Offer

  1. If an offer has a limited validity or conditions, this will be explicitly stated.
  2. The offer includes a complete and accurate description of the Products. Descriptions enable proper assessment. Illustrations are representative, but we are not bound by obvious errors.
  3. Each offer clarifies your rights and obligations upon acceptance.

The Contract

  1. The contract is concluded when you accept the offer and meet the conditions, subject to our confirmation.
  2. If accepted electronically, we will confirm receipt electronically. You may dissolve the contract until confirmed.
  3. We take measures to secure electronic data transfer and payments.
  4. We may verify your ability to pay and refuse or condition orders accordingly.
  5. Upon delivery, we provide in writing or on a Durable Medium: our contact for complaints; withdrawal information (or exclusion); guarantees; price including taxes/fees; payment/delivery method; and termination requirements if applicable.

Products and Services

We offer bespoke, handmade suits and clothing tailored to your specifications. All Products are custom-made based on measurements, fabrics, styles, and details you provide. Due to the personalized nature, each item is unique.

Product descriptions, images, and pricing are illustrative. We strive for accuracy but do not guarantee exact matches in colors, fabrics, or details due to handmade processes, device variations, or material differences. We cannot guarantee exact matches in color, size, or texture as displayed on the Site.

We guarantee Products conform to your specifications and reasonable standards of quality, but disclaim all other warranties as stated in Limitations of Liability.

Pricing and Payment

Prices are in USD and subject to change. They exclude taxes, duties, shipping, which are added at checkout.

We accept payments via Shopify methods. You authorize charges for the total amount.

We may cancel or refuse orders for any reason, with refund if charged.

Orders and Final Sale Policy

Every order is a final sale. Due to bespoke nature, we do not accept returns, exchanges, refunds, or cancellations once confirmed and production begins. Review details carefully.

We are not responsible for inaccurate measurements. We may offer discretionary adjustments or remakes for a fee.

Production timelines are estimates; delays do not entitle refund or cancellation.

Right of Withdrawal

Due to the bespoke nature of our Products (manufactured to your specifications and not prefabricated), you do not have a statutory Right of Withdrawal. All sales are final.

This exclusion applies under applicable laws, including EU consumer directives if shipping to those regions. Products manufactured according to your specifications are exempt from withdrawal rights.

If we determine a Right of Withdrawal applies in error, it would be 14 Days from delivery, but you bear return costs, and Products must be unused and in original packaging. If exercising, notify us within the period via email or unequivocal means, and return within 14 Days thereafter in original condition per our instructions. Risk and proof of return are yours.

If no withdrawal information was provided, the period extends as per law.

Shipping and Delivery

We ship via reputable carriers to specified countries. Costs and times at checkout. Not responsible for carrier/customs delays.

Title and risk pass upon delivery to carrier. You handle import duties.

If returned due to your error, you pay reshipping.

We implement orders with care, within 30 Days unless agreed otherwise. Delays allow dissolution with refund; risk of loss is ours until delivery.

Intellectual Property

All Site content (text, images, logos, designs) is owned by us or licensors, protected by IP laws. No reproduction without consent.

You grant us a license to use your custom information for order fulfillment.

We own all intellectual property rights in our Products, designs, and Site content.

If you submit user content (e.g., reviews), you grant us a perpetual license to use it promotionally. You warrant ownership and non-infringement.

Privacy

Your personal data is handled per our Privacy Policy, available on the Site. By using the Site or ordering, you consent to our practices.

Text Messaging (If Applicable)

If you opt-in to marketing texts (e.g., offers based on activity), we may send via automated systems. Consent not required for purchase. Reply STOP to opt-out. Frequency varies; data rates apply. See Privacy Policy.

Limitations of Liability

We disclaim all warranties, express or implied. Site and Products "as is."

Not liable for indirect/consequential damages. Total liability limited to purchase price.

Not liable for non-availability or delayed delivery.

Indemnification

You indemnify us from claims arising from your Site use, Terms violation, or IP infringement.

Force Majeure

Not liable for failures due to events beyond control (e.g., acts of God, war, pandemics, supply disruptions).

Governing Law and Dispute Resolution

Governed by Delaware law. Disputes resolved in Delaware courts or, at our option, binding arbitration via American Arbitration Association (AAA) before a single arbitrator. You waive jury trial, class actions. Arbitration near your residence.

You agree not to participate in class/representative actions.

Miscellaneous

Entire agreement. Invalid provisions severed. No waiver continuing. Assignable by us.
